Instructions for Mandatory Case Disclosure

This form is to be used for the filing of the Mandatory Case Disclosure. The Mandatory Case Disclosure must be completed by every Petitioner filing for divorce. The Petitioner must file the Mandatory Case Disclosure with the Court within 30 days of the filing of the Petition, or it may be filed with the petition. If there is a Marital Settlement Agreement, your spouse must ALSO sign the Mandatory Case Disclosure Acknowledgement before filing.

Fill in the Mandatory Case Disclosure as follows:

The clerk will fill in this number when you file your papers.

Fill in your name.

Fill in your spouse's name.

Fill in the information on the Petitioner. If you are the Petitioner, you must fill in all of the blank spaces. Fill in all of the information about the Respondent that you know.

If the Petitioner is employed, this section must be completed in full.

If the Petitioner is unemployed, this section must be completed in full.

If the Petitioner is disabled, this section must be completed in full.

If the Petitioner is retired, this section must be completed in full.

If the Petitioner has any other sources of income, other than from employment, unemployment, disability or retirement, this section must be completed in full.

Information on the Respondent must be completed in full if you are the Respondent. If you are the Petitioner, complete as much information about the Respondent as you know.

If the Respondent is employed, this section must be completed in full.

If the Respondent is unemployed, this section must be completed in full.

If the Respondent is disabled, this section must be completed in full.

If the Respondent is retired, this section must be completed in full.

If the Respondent has any other sources of income, other than from employment, unemployment, disability or retirement, this section must be completed in full.

In section P(1), list the name, date of birth, and age of each child born during the marriage.
In section P(2), check who the children primarily live with. If the children do not live with either your or your spouse, fill in the name of the person the children live with in the blank provided.
In section P(3), provide the information on the children's daycare or child care, if applicable.
In section P(4), provide the information on the children's health insurance plan even if the children are on Passport or another free plan provided by the state. If the children are on a private health insurance plan, be sure to fill in the blank for the cost of the health insurance for the children only, not the cost of the health insurance including the parents.
In section P(E), if either the Petitioner or the Respondent are Court ordered to pay child support on a child/children born before the children of the marriage, complete this section.

List any non-marital property of the Petitioner or the Respondent in this section. If you or your spouse have received any valuable property during the marriage by gift or inheritance or if you had valuable property before the marriage, you may want to consult an attorney. List any non-marital property owned by your or your spouse. Non-marital property is property you or your spouse acquired before the marriage or that you or your spouse received by gift or inheritance during the marriage. If you cannot agree to divide skip to section VII.

This section deals with marital property, which is generally defined as all property acquired by either spouse during the marriage, except gifts or inheritance.

State if you and your spouse have agreed upon a division of household goods and furnishings.

If not, list any valuable items of personal property such as furniture, household items, yard equipment, guns, tools, knife collection, etc.

List all vehicles including cars, trucks, boats, 4-wheelers, motorcycles, jet skis, etc. For the value column, use the NADA, Blue Book or property tax value, if you know that value.

List all bank accounts in which either Petitioner and/or Respondent are joint, sole or partial owner(s).

List all real estate owned in full or partially by Petitioner and/or Respondent.

If Petitioner or Respondent has any type of retirement plan, either through a current or former employer such as a pension, profit sharing or 401k plan, or a private account, such as an IRA, this section must be completed. Fill in as much information as you know about the plan. If you believe that your spouse has a retirement plan through his/her employer, but you do not know any details about the plan, you may want to consult an attorney.

If you or your spouse have any other property of value that has not already been listed on this form, list it in this section. For example, stocks or bonds.

List all debts owed by either the Petitioner or the Respondent or jointly by both parties. Provide as much information as possible regarding each debt.

| BB. | Print your full address, including street number, street name, city, state and zip code. If you have been the victim of domestic violence and do not wish your spouse to have your current address, do not list your address. |

| DD. | Print the name of the other party in the action as listed in B or C on the first page. Then, on the lines provided, fill in that person's complete address, including the street number, street address, city, state and zip code. Also, fill in the area code and telephone number. |
| EE. | Sign your name and fill in the date. |
YOU MUST PROVIDE THE FULL NAME AND CORRECT ADDRESS OF THE OTHER PERSON INVOLVED IN THIS ACTION. By signing the "Certification" section of this document, you are "promising" to the Court that the information you have provided regarding the name, address and telephone number of the other party is correct. If you DO NOT KNOW THE LOCATION OF YOUR SPOUSE, write the last know address and put "last known" in parentheses or if you know no address write "unknown." If your spouse is in agreement as to the information you have provided on the form, he or she should complete Respondent's Mandatory Case Disclosure Acknowledgement (Word format).
Take the original to the Office of the Clerk of Jefferson County Family Court located at 700 West Jefferson Street, Louisville, Kentucky. Present the original to the Clerk. You will be required to pay for two copies - one for you and one to be sent to the other party. The Clerk will give you back two sets of the photocopies. You should keep one for your records and go to the mailroom to mail the other copy to the other party. The Clerk will direct you to the mailroom.
