The following document ONLY applies to jurisdictions in Kentucky that have enacted the Uniform Residential Landlord Tenant Act. These jurisdictions are: Barbourville, Bellevue, Bromley, Covington, Dayton, Florence, Lexington-Fayette County, Georgetown, Louisville-Jefferson County, Ludlow, Melbourne, Newport, Oldham County, Pulaski County, Shelbyville, Silver Grove, Southgate, Taylor Mill and Woodlawn.

Further, this information only applies to residential leases. It does not apply to: commercial units, properties under contract for sale, hotels or motels, or people who are employed by the landlord.


Here is a sample letter you can send your landlord requesting the return of your security deposit because you never occupied the unit. See Tenant's Guide to Security Deposit Problems for more information.

Dear Landlord:

On the _______ day of ____________________, 20___, I gave you a security deposit in the amount of $______________. As of this date, I have never occupied any of your premises.

KRS 383.545 provides that a security deposit is for the purpose of securing the landlord "against financial loss due to damage to the premises occasioned by the tenant's occupancy other than normal wear and tear."

Please be advised that there was no damage to the premises due to any occupation by me, and therefore, I am entitled to a return of the full amount of my security deposit. If the full amount is not returned within ten (10) days of receipt of this notice, legal action may be taken to obtain the full amount of the security deposit.
